Agreement to Arbitrate: This Dispute Resolution by Binding Arbitration section is referred to in these Terms as the “Arbitration Agreement.” You agree that any and all disputes or claims that have arisen or may arise between you and Pinehurst Coins, whether arising out of or relating to these Terms of Service (including any alleged breach thereof), the Services, any advertising, any aspect of the relationship or transactions between us, shall be resolved exclusively through final and binding arbitration, rather than a court, in accordance with the terms of this Arbitration Agreement, except that you may assert individual claims in small claims court, if your claims qualify. Further, this Arbitration Agreement does not preclude you from bringing issues to the attention of federal, state, provincial or local agencies, and such agencies can, if the law allows, seek relief against us on your behalf. You agree that, by entering into these Terms, you and Pinehurst Coins are each waiving the right to a trial by jury or to participate in a class action. Your rights will be determined by a neutral arbitrator, not a judge or jury. If you reside in the U.S., the Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement. Prohibition of Class and Representative Actions and Non-Individualized Relief: YOU AND PINEHURST COINS AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND PINEHURST COINS AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S). Pre-Arbitration Dispute Resolution: Pinehurst Coins is always interested in resolving disputes amicably and efficiently, and most customer concerns can be resolved quickly and to the customer’s satisfaction by emailing customer support at [email protected]. If such efforts prove unsuccessful, a party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”). The Notice to Pinehurst Coins should be sent to Pinehurst Coins, P.O. Box 3686, Pinehurst, NC 28374 (“Notice Address”). The Notice must (i) describe the nature and basis of the claim or dispute and (ii) set forth the specific relief sought. If Pinehurst Coins and you do not resolve the claim within sixty (60) calendar days after the Notice is received, you or Pinehurst Coins may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by Pinehurst Coins or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or Pinehurst Coins is entitled. Arbitration Procedures: Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association’s (“AAA”) rules and procedures, including the AAA’s Supplementary Procedures for Consumer-Related Disputes (collectively, the “AAA Rules”), as modified by this Arbitration Agreement. For information on the AAA, please visit its website, http://www.adr.org. Information about the AAA Rules and fees for consumer disputes can be found at the AAA’s consumer arbitration page, http://www.adr.org/consumer_arbitration. If there is any inconsistency between any term of the AAA Rules and any term of this Arbitration Agreement, the applicable terms of this Arbitration Agreement will control unless the arbitrator determines that the application of the inconsistent Arbitration Agreement terms would not result in a fundamentally fair arbitration. The arbitrator must also follow the provisions of these Terms of Service as a court would. All issues are for the arbitrator to decide, including, but not limited to, issues relating to the scope, enforceability, and arbitrability of this Arbitration Agreement. Although arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings, the arbitrator can award the same damages and relief on an individual basis that a court can award to an individual under the Terms of Service and applicable law. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons. Unless Pinehurst Coins and you agree otherwise, or if otherwise prohibited by AAA Rules, any arbitration hearings will take place telephonically, in a location in Moore County, or as otherwise determined by Pinehurst Coins. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based. Bullion Items

Bullion for investment purposes can be a great way to buy into precious metals market; however, all investments come with risks. There are many factors that affect the price of precious metals. We strongly recommend that you consult your financial expert prior to investing in any of our bullion items. Pinehurst Coins does not provide any investment advice and cannot be held liable for any market gains or losses through the purchase or sale of bullion or coin items that we provide.

Cancellation

We understand circumstances may arise that require you to cancel an order. All cancelations must be pre-approved by a customer service representative over the phone. If approved, your order will be assigned a cancellation number. Please call us at (910) 235 – 2646, Monday – Friday, 10am-5pm to speak with a customer service representative. All canceled orders are subject to market risk due to “locked-in” pricing, as described in our Price Confirmation Section.  All cancellations are subject to a $35.00 (USD) cancellation fee plus any market loss incurred pursuant to our Market Fluctuation Policy.  Market gains, if any, on cancellations will remain the property of Pinehurst Coins.  All cancellation fees and losses pursuant to our Market Fluctuation Policy must be paid by credit card at this time. No future orders will be permitted until these fees are paid.

Graded Coins

Pinehurst Coins offers only NGC and PCGS certified coins due to the subjective nature of coin grading. Both NGC and PCGS are third-party grading services that personally guarantee their grades. They are the two most respected grading services in the numismatic industry. This allows our customers to buy from us with confidence, knowing they are purchasing a top-quality guaranteed product. The coin market is volatile and always fluctuating. This can result in a loss or gain of value on any given coin you purchase. Pinehurst Coins wants to remind buyers that past performance can in no way be used to predict the future value. Buyers should consider these coins strictly as collector’s coins and any investment advice must be obtained strictly from the buyer’s own financial experts.

Market Fluctuation Policy

Upon placing your order the transaction becomes a binding agreement, whether buying or selling. Your price becomes locked-in as soon as you click “place order” during the checkout process. You’ll be emailed a confirmation number as soon as your order is placed. If you cancel your order once placed, any amount refunded will be offset by our current buy price. For additional clarity, you will be responsible for any loss in value incurred during the cancellation process, as well as, a $35.00 (USD) cancellation fee. All market gains on returns or cancellations will remain the property of Pinehurst Coins.

Price Confirmation (On bullion Items)

Our Hedge Management system pulls pricing via an API call from Tornado Bullion (see Tornado Bullion) and streams such pricing as a banner at the top of our Website. All prices quoted on our Website are in U.S. Dollars. We strive hard to assure the accuracy and information of the products and pricing that we provide on the Website. However, discrepancies in terms of inventory or pricing may occur at times due to any number of factors including, but not limited to availability, changing market conditions, as well as human errors (e.g. typos). In all instances, Pinehurst Coins has the right at its sole discretion to cancel or refuse any orders placed on any item. We will notify you via email of such cancellation and do apologize if situations like this arise. In addition to the other rights and remedies available to Pinehurst Coins, in the event of any failure by you to comply with these Terms, we reserve the right to charge the credit card which you have provided to us including, without limitation, any and all market losses incurred by us including cancellation fees for accepting your orders to either buy from or sell to us as a result of price and market fluctuations for which you did not fulfill. You expressly authorize Pinehurst Coins to charge your credit card for all of such amounts. See our Market Fluctuation Policy. In all situations, final pricing for your order will be determined at the time of checkout where you will have 10 minutes to complete the checkout process or the prices will then readjust after that 10-minute interval has elapsed. All check and wire transactions must be secured by authorizing 10% of your order total on a credit card. The full amount of the order is to be remitted to Pinehurst Coins via check or wire. Failure to meet these deadlines will void any “locked-in” pricing.

Price Match Guarantee

We guarantee to match any of our approved competitors’ advertised prices! To qualify for our Price Match Guarantee, the item you would like to match must be identical to ours. Certified coins must have the same coin, grade, and label. Bullion must be the same metal type, manufacturer, size (weight, denomination,) quality, and quantity (number of units for a certain price level or tier.) The price must be advertised on our competitor’s website and one of our representatives must be able to verify that price. Item prices listed on auction sites, such as eBay, Amazon and other third-party seller platforms, do not qualify for our Price Match Guarantee. We will only match the total price of an item, including the advertised price and all fees and/or shipping costs. Our Price Match Guarantee only references current advertised prices and does not apply to orders that have already been placed. Matched prices must be approved by a customer service representative before they can be applied to your order. Our Price Match Guarantee may be declined at our discretion. These terms are subject to change without notice. Privacy Policy

If you are not completely satisfied with your non-bullion purchase, please call us at (910) 235-2646 to discuss your concerns with a customer service representative. All non-bullion items can be returned and/or exchanged if you call us within three (3) days of delivery of your order. Returns or exchanges must remain in their original packaging. Items removed from the original packaging cannot be returned. Shipping and handling charges will not be refunded. In all situations, final pricing for your order will be determined at the time of checkout where you will have 10 minutes to complete the checkout process or the prices will then readjust after that 10-minute interval has elapsed. All returns and exchanges are subject to a 5% restocking fee.
